#What the User should know at a glance

• The Service is provided by: Easy Auth, an independent software project, operated on a personal basis and not incorporated as a company, based in Italy. Contact email: [CONTACT EMAIL].
• Subscriptions renew automatically. Information about the renewal period, cancellation and related procedures can be found in the relevant section of these Terms.
• The 14-day right of withdrawal is granted to all Users, regardless of whether they qualify as European Consumers.
• A 7-day free trial is offered with the first subscription of each server.
• Some provisions in these Terms may only apply to certain categories of Users (in particular, to Consumers): such limitations are always explicitly mentioned within each affected clause.

#1. Purpose

These terms and conditions (the “Terms”) govern the use of the Easy Auth Discord bot (the “Bot”), the website and its configuration dashboard (the “Platform”), as well as the features offered through them (collectively, the “Service”), by users (the “User” or “Users”).

#2. Acceptance of Terms – Changes to the Terms

Use of the Service implies full acceptance of these Terms. If the User does not intend to accept them, they must not use the Service.

The User also agrees that personal data processed in connection with the Service will be handled in accordance with the Easy Auth Privacy Policy, available on the website.

The Owner reserves the right to modify these Terms at any time. Changes will be communicated to Users through the website and/or the Easy Auth support Discord server, and the most current version will always be available on the Platform with an indication of the date of the latest revision. Continued use of the Service after such changes constitutes acceptance thereof; Users who do not wish to accept the changes must stop using the Service. Changes will only affect the relationship for the future.

Easy Auth is not affiliated, associated, authorized, endorsed by, or in any way officially connected with Discord Inc. Use of the Discord platform is subject to Discord’s terms of service and policies, available at https://discord.com.

#4. User eligibility

To use the Service, the User must have a valid Discord account and comply with Discord’s terms of service.

The User represents and warrants that they are legally able to accept these Terms and that they are legally authorized in their jurisdiction to use the Service. The User is solely responsible for compliance with all applicable laws in their jurisdiction.

#5. Features of the Service

Easy Auth provides features for the verification and authentication of Discord server members, automatic role management, and server protection and security. The nature, content and availability of the individual features are described on the Platform, in the version made available from time to time.

All features are optional and are enabled and configured by server administrators. Actions performed by the Bot within a server (such as verifications, role assignments, removals or other measures) depend on the configurations chosen by the server’s administrators, who are solely responsible for such configurations and their effects on the members of their server.

The Service is offered under a “freemium” model: basic features are free of charge, while certain additional features (“Premium”) are accessible through a paid subscription.

The User acknowledges that the features of the Service, both free and Premium, may evolve over time at the Owner’s discretion, and that any fees paid relate to the general use of the Premium features as made available from time to time on the Platform.

#6. Registration and account

Access to the dashboard takes place through Discord OAuth2 authentication. Easy Auth does not receive or store the credentials of the User’s Discord account. The use of certain features of the Service (for example, interacting with the Bot as a member of a server) does not require access to the dashboard.

Users are responsible for keeping their Discord credentials confidential and safe and for all activities carried out through their account. Users are required to promptly inform the Owner, via the contact details indicated in this document, if they believe their account or their data has been violated or used without authorization. The Owner cannot and will not be liable for any loss or damage arising from the User’s failure to comply with this section.

Providing false or fraudulent information is prohibited and may lead to suspension or termination of access to the Service.

#7. Premium subscriptions

7.1 Orders and prices

Before submitting an order, the User is informed of the prices and any applicable taxes and costs. Prices displayed on the Platform are inclusive of applicable taxes, unless otherwise indicated.

The submission of an order determines contract conclusion and creates for the User the obligation to pay the indicated fee. Upon submission of the order, the User will receive a confirmation of receipt.

7.2 Duration and automatic renewal

Premium subscriptions grant access to the Premium features for the server they are associated with, for the period chosen at the time of purchase. The subscription begins on the day the payment is received by the Owner (or at the end of any free trial period).

Subscriptions are automatically renewed at the end of each period, for a period equal to the original term, through the payment method chosen by the User, unless the subscription is cancelled before the renewal date.

The User may cancel the subscription at any time through the dashboard or by contacting the Owner. Cancellation takes effect at the end of the current subscription period: until that date, the User continues to have access to the Premium features. Failure to pay the recurring fee will cause the interruption or suspension of access to the Premium features.

7.3 Free trial

A 7-day free trial is offered with the first subscription of each server. The free trial is available only once per server, regardless of the User making the purchase, and does not apply to subsequent subscriptions relating to the same server.

At the end of the trial period, the subscription automatically continues as a paid subscription, unless cancelled before the trial expires.

7.4 Methods of payment

Payments are processed through external payment service providers (currently Stripe). The Platform does not collect full payment instrument details, but only receives a notification of the outcome of the payment.

If payment fails or is refused by the payment service provider, the Owner shall be under no obligation to provide the Premium features. Any costs resulting from the failed or refused payment shall be borne by the User.

7.5 Offers, discounts and coupons

The Owner may offer, at its sole discretion, discounts, promotional offers or coupons for the purchase of Premium subscriptions. Such offers are subject to the eligibility criteria and conditions indicated at the time of their presentation, may be limited in time, and create no claim, title or right that Users may enforce in the future, even in the case of repeated or recurring offers.

Unless otherwise stated, coupons are only valid in the manner and within the timeframe specified, may be applied only once at the time of purchase, are not redeemable for cash, and are not transferable or usable for commercial purposes. In the event of a breach of the applicable conditions or abusive use, the Owner may refuse their application and reserves the right to take any appropriate action to protect its rights.

The Owner may also grant, at its sole discretion, free or complimentary Premium periods associated with a specific server: such grants do not give rise to any right to refunds, are not transferable, and create no right or expectation for the future.

#8. Right of withdrawal and refunds

8.1 Right of withdrawal

The User may withdraw from the subscription contract, without having to provide any reason, within 14 days from the conclusion of the contract. The Owner voluntarily grants this right to all Users, including those who do not qualify as European Consumers, to whom the right would be granted by law.

To exercise the right of withdrawal, the User must send to the Owner, via the contact details indicated in this document or the support Discord server, an unequivocal statement of their intention to withdraw from the contract. To this end, Users may, but are not required to, use the model withdrawal form available at the end of these Terms. The deadline is met if the notice is sent before the withdrawal period expires.

8.2 Effects of withdrawal

In the event of a validly exercised withdrawal, the Owner will reimburse the payments received without undue delay and, in any event, no later than 14 days from the day on which the Owner is informed of the decision to withdraw, using the same means of payment as used for the initial transaction, unless otherwise agreed with the User and without any additional costs for the User.

Withdrawal results in the immediate termination of access to the Premium features covered by the refund.

Where the User has requested that the provision of the Premium features begin before the withdrawal period expires, the User shall pay to the Owner an amount which is proportional to the part of the service provided until the time of withdrawal, compared with the full coverage of the contract.

No refund is due in relation to free trial periods.

8.3 Limits on repeated requests

Without prejudice to the statutory right of withdrawal granted to consumers, the Owner reserves the right to limit or refuse repeated refund requests relating to the same service or the same server made within a short period of time of one another, where the User’s conduct constitutes an abusive or instrumental use of the right of withdrawal or of the refund policies (for example, repeated purchase-and-refund cycles aimed at using the Premium features free of charge).

8.4 Renewals

The right of withdrawal set out in this section applies to the conclusion of the contract. To avoid being charged for automatic renewals, the User must cancel the subscription before the renewal date, as set out in section 7.2. In the event of an issue with a charge (for example, forgetting to cancel a subscription), the User may contact the Owner, who will assess the request in good faith.

#9. License – IP rights

The Owner grants the User a limited, non-exclusive, non-transferable, non-sublicensable license to use the Service, for the duration of the use or of the subscription and solely for the User’s own purposes. The license relating to the Premium features is conditional upon the regular payment of the applicable fees.

The software, source code, structure, organization, trademarks, logos, names and any other content relating to the Service constitute intellectual property of the Owner or its licensors and are protected by applicable laws. The Service is licensed, not sold: no title or ownership rights are transferred to the User.

Except to the extent strictly necessary for the normal use of the Service, the User may not copy, modify, distribute, sell, sublicense, decompile, disassemble or reverse engineer the Service or any part thereof, nor attempt to derive its source code. Any applicable statutory limitations or exceptions shall remain unaffected.

#10. User content

Through the dashboard, server administrators may provide their own content, such as custom texts and messages (for example, verification messages and embeds).

By providing such content, the User confirms that they are its legitimate owner or are authorized to use it, and that they are not infringing any statutory provisions and/or third-party rights. The User grants the Owner a non-exclusive, royalty-free license to process such content solely for the operation and maintenance of the Service.

The User is solely liable for the content they provide. The Owner does not carry out prior review of such content, but reserves the right to remove, block or rectify it, and to suspend the affected User’s access to the Service, in the event of complaints, infringement of third-party rights, orders of an authority, or risks for other Users or for the Service, without this giving rise to any right to compensation or refund.

#11. Acceptable use and usage limits

11.1 Acceptable use

The Service may only be used within the scope of what it is provided for, in compliance with these Terms, Discord’s terms of service and applicable law.

In particular, Users are prohibited from: using the Service for unlawful, offensive or abusive purposes; interfering with the proper functioning of the Service or attempting to damage, overload or alter it; circumventing or attempting to circumvent technical limitations, usage limits or security features; accessing the Service or its interfaces through unauthorized automated tools (such as bots, scripts, scrapers or other automated means); making bulk, repeated or otherwise anomalous requests to the Service; introducing viruses or other malicious code; reselling, duplicating or commercially exploiting the Service or any part thereof without the Owner’s prior written permission; infringing third-party rights.

The Owner reserves the right to take any appropriate measure to protect its legitimate interests, including suspending or terminating access to the Service and reporting misconduct to the competent authorities.

11.2 Usage limits, rate limiting and protective measures

In order to ensure the stability, security and usability of the Service for all Users, as well as to comply with the technical limits imposed by the Discord platform and its APIs, the Owner may at any time apply technical and usage limits, such as request frequency limits (rate limiting), thresholds, quotas or functional restrictions. Such limits may vary depending on the plan used (free or Premium) and may be modified over time, including without prior notice.

In the presence of anomalous, excessive or abusive uses of the Service, or of conduct likely to compromise its stability or security, the Owner may apply temporary limitations, reduce the priority or frequency of processing of requests, or suspend or terminate access to the Service, including without prior notice in urgent cases.

The application in good faith of the measures set out in this section shall not give rise to any right to compensation, damages or refunds for the User, without prejudice to the mandatory rights granted to consumers by law.

#12. Suspension and termination

12.1 By the Owner

The Owner may at any time suspend, limit or terminate the User’s access to the Service, in whole or in part, in the event that: (a) the User fails to pay the applicable fees; (b) the Owner reasonably suspects a breach of these Terms or of the law; (c) it is required to do so by law or by an authority; (d) there are security concerns or suspicions of fraudulent or unauthorized use.

In the event of suspension or termination due to a breach of the Terms, the User shall not be entitled to any refund, compensation or damages, without prejudice to the mandatory rights provided by law.

12.2 By the User

The User may stop using the Service at any time, by removing the Bot from their servers and/or cancelling any subscription as set out in section 7.2, or by contacting the Owner.

12.3 Consequences of termination

Upon termination, the license rights granted to the User shall terminate and the User must cease all use of the Service. Fees accrued up to the effective date of termination remain due. No refunds are provided for periods of use already elapsed, without prejudice to the right of withdrawal set out in section 8 and any other mandatory right provided by law.

#13. Disclaimer of warranties

The Service is provided on an “as is” and “as available” basis, without warranties of any kind, either express or implied, to the extent permitted by applicable law.

The Owner does not warrant that the Service will be continuous, uninterrupted, timely, secure or error-free. The User acknowledges that the Service may contain bugs, errors or defects, may be subject to periods of downtime or unavailability, may result in loss or corruption of data, and may be modified at any time, including through the release of subsequent versions.

The User further acknowledges that the Service depends on the Discord platform and its APIs: any interruptions, malfunctions or changes to Discord may affect the availability or functioning of the Service, without this being attributable to the Owner.

For Users who qualify as consumers, the mandatory warranties provided by law remain unaffected, including those relating to the conformity of digital content and digital services.

#14. Limitation of liability

To the extent permitted by applicable law, the Owner shall not be liable for indirect, incidental or consequential damages of any kind (including, but not limited to, loss of profits, data, goodwill or opportunities) arising from the use of, or inability to use, the Service.

The User specifically acknowledges that actions performed by the Bot within servers (such as verifications, sanctions, removals or restrictions applied through anti-raid, join gate or similar features) depend on the configurations chosen by the server administrators, who are solely responsible for them.

If, notwithstanding the above, the Owner is found liable, its aggregate liability shall be limited to the amount of the fees paid by the User for access to the Premium features during the twelve (12) months preceding the event giving rise to the liability.

The exclusions and limitations set out in this section shall not apply where liability cannot be excluded or limited under applicable law, nor to the mandatory rights granted to consumers.

#15. Indemnification

The User agrees to indemnify and hold the Owner harmless from any third-party claim or demand (including reasonable legal fees) arising out of or related to: (a) the User’s breach of these Terms; (b) the User’s use of the Service, including the configurations set and the content provided; (c) the User’s violation of any law or third-party rights. This clause shall not apply to Users who qualify as consumers, where prohibited by applicable law.

#16. General provisions

Assignment. The User may not transfer or assign their rights or obligations under these Terms to any third party without the Owner’s written consent. The Owner may assign these Terms in the context of a transfer or reorganization of the project, informing Users thereof.

Interruptions. The Owner reserves the right to temporarily interrupt the Service for maintenance, updates or changes, informing Users where possible. The Service may also be unavailable due to force majeure or other causes beyond the Owner’s reasonable control.

External resources. Through the Service, Users may have access to resources, services or content provided by third parties (such as, by way of example, the Discord platform, payment services or links to external websites). The User acknowledges that the Owner has no control over such resources and is therefore not responsible for their content, availability or applicable conditions, which remain governed by the terms of the respective providers.

Severability. The invalidity or unenforceability of any provision of these Terms shall not affect the validity of the remaining provisions. The invalid provision shall be replaced or interpreted so as to accomplish, to the greatest extent possible, its original objectives.

Waiver. The delayed exercise or non-exercise of any right by the Owner shall not be construed as a waiver of such right.

Section titles. The section titles in these Terms are for convenience only and have no legal or contractual effect.

Notices. Communications relating to the Service, including changes to these Terms, are made through the website, the dashboard and/or the Easy Auth support Discord server. Notices to the Owner must be sent to the email address indicated in this document.

Entire agreement. These Terms, together with any documents expressly referred to herein (including the Privacy Policy), constitute the entire agreement between the parties in relation to the Service.

#17. Governing law and jurisdiction

These Terms are governed by the law of the place where the Owner is based. However, if the User qualifies as a European Consumer and has their habitual residence in a country where the law provides for a higher consumer protection standard, such higher standards shall prevail.

The exclusive competence to decide on any controversy resulting from or connected to these Terms lies with the courts of the place where the Owner is based. This provision does not apply to Users who qualify as European Consumers, nor to Consumers based in Switzerland, Norway or Iceland, for whom the mandatory jurisdiction rules provided by law remain unaffected.

Amicable dispute resolution. Users may submit any complaints to the Owner through the contact details provided in this document, including a brief description and, if applicable, the details of the related order or account. The Owner will process the complaint without undue delay, within 21 days of receiving it.

Online dispute resolution for Consumers. The European Commission has established an online platform for alternative dispute resolution that facilitates an out-of-court method for solving disputes related to contracts entered into online, available to European Consumers at the following link: https://ec.europa.eu/consumers/odr/
